The short version: we respect you and your data.

What this covers

These terms govern your use of the Fathom mobile application and any associated cloud services operated by Fathom ("we", "us", "our"). By downloading, installing, or using Fathom, you agree to be bound by these terms. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old to use Fathom (16 in Quebec). By using the app, you represent that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these terms.

The app

Fathom operates entirely on your device with no account required. We provide it as-is, with no warranty of any kind. We may update the app, but your local data remains yours. We have no access to your financial data.

Future paid services

We may introduce optional paid services in the future (such as cloud sync or household sharing). If we do, they will be billed in Canadian dollars through Apple (App Store) or Google (Play Store). You will be able to cancel anytime — your local data stays yours. These terms will be updated before any paid services launch.

Your data

You own your financial data. We never sell, share, or monetize it. You may export your data at any time in CSV or JSON format via the app. If we introduce cloud services in the future, they will use end-to-end encryption — we will store only ciphertext that we cannot decrypt.

Acceptable use

You agree not to: reverse engineer, decompile, or disassemble the app; use the app to process data for third parties on a commercial basis; attempt to circumvent the app's security or encryption; use automated tools to access the app's cloud services beyond normal usage; or misrepresent your identity when connecting email or financial accounts.

Intellectual property

The Fathom app, its design, code, and documentation are owned by us and protected by copyright and trademark law. Your financial data belongs to you — we claim no ownership or licence over it. Category templates you publish via the app's sharing features are published under your chosen identity and remain yours.

Limitation of liability

Fathom is a personal finance tool, not a financial advisor, tax preparer, or accounting service. We are not liable for financial decisions made based on information displayed in the app, including categorization suggestions, spending insights, AI-generated analysis, or CRA category mappings. Always consult a qualified professional for tax, legal, and financial advice. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF FATHOM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 CAD, WHICHEVER IS GREATER.

Warranty disclaimer

FATHOM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT FINANCIAL DATA WILL BE ACCURATE. OCR, AI PARSING, AND AUTOMATED CATEGORIZATION ARE BEST-EFFORT — ALWAYS VERIFY IMPORTANT FIGURES AGAINST YOUR ORIGINAL DOCUMENTS.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your use of the app, your violation of these terms, or your violation of any third party's rights.

Termination

You may stop using Fathom at any time by deleting the app. Your local data remains on your device. If we introduce cloud services in the future, we may suspend access for terms violations with reasonable notice, and cloud data would be retained for 30 days to allow export before permanent deletion.

Governing law & disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these terms or your use of Fathom shall be resolved in the courts of Ontario, Canada. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.

Changes to these terms

We may update these terms. Material changes will be communicated through the app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
